Legal Entity

The Busy Mouse Company (or busymouseco. , The Busy Mouse Co. or BMC) is a UK Based startup company, (‘we’, ‘us’ or ‘our’) is the supplier of the products (‘Products’) available on thebusymouseco.com (‘our site’)

Acceptance of terms

By using www.thebusymouseco.com you agree to be bound by these terms and conditions.

These terms and conditions (together with the documents referred to in them) tell you the terms and conditions on which we supply any of the Products to you. Please read these terms and conditions carefully and make sure that you understand them, before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.

You keep a copy of these terms and conditions for future reference.

Please understand that if you refuse to accept these terms and conditions, you will not be able to and should not order any Products from our site.

The Busy Mouse Company startup business reserves the right to update its terms and conditions from time to time.

Pricing and Availability

All prices are stated in British pounds. Please note you are responsible for complying with local tax laws. The Busy Mouse Company reserves the right to change Product prices and information without prior notice.

All Products are subject to availability. If a Product is temporarily out of stock please email us on thebusymouseco@gmail.com and we’ll notify you as soon as it’s back online. Alternatively keep checking the website.

Eligibility

By placing an order through www.thebusymouseco.com, you represent and warrant that:

(a) you are legally capable of entering into binding contracts;

(b) you are at least 18 years old;

(c) are the holder of a valid debit/credit card;

Payment

The Busy Mouse Company uses Stripe to process payments. You may view Stripe terms and conditions via https://stripe.com/en-gb/privacy.

Your contract with us

After placing an order, you will receive an e-mail from The Busy Mouse Company acknowledging your payment. Please note this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail stating that the payment has been processed and that your Products have been dispatched (‘Dispatch Confirmation’). The contract between us (‘Contract’) will only be formed when we send you the Dispatch Confirmation.

The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.

Product information

The Busy Mouse Company has made every endeavour to ensure photographs, dimensions and Product descriptions represent our Products as accurately as possible. In some instances there may be a slight variation in appearance and colours of the actual Products due to the production process, the lighting in which they were photographed or your computer’s monitor settings.

Shipping

The Busy Mouse Company aims to deliver all mainland UK orders within 5 working days using Royal Mail’s postal service or a chosen courier. Sometimes due to unforeseen circumstances such as severe weather, strike action or during busy times like Christmas, deliveries may take a little longer. If you have not received your delivery within 14 working days, please contact us on thebusymouseco@gmail.com  

Please note that any import duties and taxes are your responsibility.

Risk and Ownership

The Products will be at your risk from the time of delivery.

Legal ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges. Legal ownership of the Products will immediately revert to us if we refund any such payment to you.

Our Refunds Policy

We really hope you love your Busy Mouse Company products. If you are not entirely happy please notify us on thebusymouseco@gmail.com. You must return your unwanted Products for a refund within 10 working days from the day you received the Products. The Products, including their original packaging, must be returned “as new” in a saleable condition. We cannot cover return postage fee costs, and for all returns and refunds request  that you please obtain a proof of postage certificate from your Post Office as we cannot refund products damaged or lost in transit. We will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund. We will refund the price of the Products in full. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. This provision does not affect your statutory rights as a consumer.

Damaged Products and order Cancellations/Amendments

Every Busy Mouse Company Product is thoroughly checked before it’s posted but if, in the unlikely instance, you do receive faulty Products please contact The Busy Mouse Company on thebusymouseco@gmail.com within 14 from receipt of your delivery letting us know whether you would like an exchange or a refund. We recommend you inspect your Products as soon as they arrive. It is important when returning Products that you obtain a proof of postage as we cannot refund items lost in transit. If you return a defective Product to us:

(a) and you have elected for a refund. We will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund. We will refund the price of a defective Product in full, any applicable delivery charges and any reasonable costs you incur in returning the item to us as we see appropriate; or

(b) and you have elected for an exchange. We will examine the returned Product and will notify you of your exchange via e-mail within a reasonable period of time. We will usually dispatch the exchange to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to an exchange. For exchange service, we will cover postage costs only if there is damage to the product, and not if the exchange is requested relating to change in preference.

We will refund the customer any reasonable costs incurred in returning the item to us should the item be received by the buyer in poor/damaged condition. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. This provision does not affect your statutory rights as a consumer.

Note, we cannot process a refund, exchange, order cancellation or amendment if the product has left the studio to be delivered and is awaiting delivery. We will be very happy to process a refund, exchange, order amendment or cancellation upon your receipt of the product, or if the refund, exchange, order cancellation or amendment is requested before the product has been sent out in the post.

All trade marks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

Written Communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. Notices All notices given by you to us must be given to The Busy Mouse Company at thebusymouseco@gmail.com. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in Written Communications clause above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such email was sent to the specified e-mail address of the addressee.

Consumer Rights

As a consumer, you may cancel a Contract at any time within ten working days, beginning on the day you received the Product(s). To cancel a Contract, you must inform us by email. You must also arrange to have the Products delivered to us as soon as reasonably practicable “as new”, packaged in a saleable condition, at your own cost. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. This provision does not affect your statutory rights as a consumer.

Entire Agreement

We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. Pllease make sure you ask for any variations from these terms and conditions to be confirmed in writing.

Severability

If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Law and Jurisdiction

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the nonexclusive jurisdiction of the courts of England and Wales.

Payments

  • You agree not to hold us responsible for any banking charges incurred due to payments on your account.

  • International postage charges if requested differ from uk mainland charges

  • Payments can be made by Visa, Visa Electron, Visa Debit, Visa Delta, Mastercard. Payment will be debited and cleared from your account immediately on order.

  • We take reasonable care to make our site secure. All credit/debit transactions on this site are processed using Stripe. You can find out more information about how stripe works by visiting https://stripe.com/gb

  • We reserve the right to suspend or cancel your purchase at any time, for any reason we see viable. You will be notified if this is the case and a refund will be provided for any Products not sent that have been paid for.

Postage

  • We currently use royal mail to deliver your product. Delivery times on average are: UK 1-5 days

  • You may not hold us responsible for any delays, outside our control, which relate to the delivery of your product.

  • It is the customer’s responsibility to report all lost Products within 14 days for UK; international customers vary.

  • If you change address, you must contact us to ensure that no Products are sent out to the wrong delivery address. Please ensure that this is done in time to take effect before you move, as you will be liable for any post sent to the wrong address.

  • All parcels will be sent out 1st class royal mail, however it is subject to the size and weight of the package. We reserve the right to send some packages as 2nd class without notifying you.

Loyalty codes & competitions

  • Any promotion code or offer provided on this site cannot be used in conjunction with any other promotion, past or present.

  • Promotion codes have no cash alternative and must be redeemed by the date published, if provided.
